Notarial will
A handwritten will is valid in Poland, but it is easy to lose and more often challenged by the family. The original of a notarial will stays at the notary’s office and can be registered in the Notarial Register of Wills, so your family will find out about it.
What you gain
The notary checks the identity of the person making the will and makes sure the wording is clear, so that the family has nothing to argue about later. We keep the original and the heirs receive an official copy. Only a notarial will can contain a specific bequest (zapis windykacyjny), which passes a particular item, for example an apartment, directly to the chosen person.
Changing a will and home visits
You can change or revoke a will at any time by making a new one. If you cannot come to the office because of illness, the notary can visit you at home or in hospital; please call to arrange a date.
Notarial deeds in Poland are always drawn up in Polish. We are happy to talk to you in English, but if you do not speak Polish well enough to follow the deed, a sworn translator has to be present when it is signed. Let us know in advance and we will help arrange one.
Costs
The maximum fee is PLN 50 net for a simple will, PLN 150 net for a will with a legacy, instruction or disinheritance and PLN 200 net for a will with a specific bequest, plus VAT and copies. See Notary fees.
Frequently asked questions
Notarial or handwritten will?
A handwritten will costs nothing, but it is easier to lose, destroy or challenge in court. A notarial will is harder to contest, the original stays at the office and it can be entered in the Notarial Register of Wills.
Can I leave a specific item to a chosen person?
Yes, through a specific bequest, which is only possible in a notarial will. The person receives, for example, an apartment or company shares at the moment of death, without waiting for the estate to be divided.
Can the notary come to me?
Yes, if the situation requires it, for example illness or disability. An additional fee is charged for each hour started outside the office. Please arrange the date by phone.
