Polish family foundation
A Polish family foundation (fundacja rodzinna) is used to protect family wealth and plan who will run the family business in the future. It cannot be set up without a notary, because the founding deed and the statute must be notarial deeds.
Setting up a foundation
The founder creates the foundation in a founding deed or in a notarial will, together with a statute setting out its name, purpose, beneficiaries, management board and rules of payments. A list of the assets contributed by the founder is attached; they must be worth at least PLN 100,000.
The management board then applies for entry in the register of family foundations kept by the District Court in Piotrków Trybunalski. The foundation gains legal personality on the date of entry.
Founders and beneficiaries
The founder must be a natural person with full legal capacity; several people can found a foundation together. Beneficiaries are usually family members, but can also include public benefit organisations. The founder can be a beneficiary as well.
Notarial deeds in Poland are always drawn up in Polish. We are happy to talk to you in English, but if you do not speak Polish well enough to follow the deed, a sworn translator has to be present when it is signed. Let us know in advance and we will help arrange one.
